Article 1 - Opposability

All sales are concluded subject to the following clauses and general conditions except when other arrangements have been agreed upon.


Article 2 - Description

The catalogue presented on our web site is not contractual. Cuisine Innovation reserves the possibility of modifying the range of equipment
and products offered, their technical characteristics and their prices.


Article 3 - Pices - Payment

Equipment and Products:
Our prices are excluding VAT, and don't include postage, except for the immersion heater wich is postage paid.
The postage is added at each shop. Our products are provided at the price current at the time when you order.
Payment required when you order.
Three forms of payment are accepted:

  • postal or bank cheque,
  •  
  • postal or bank transfer.

    Advice and training courses:
    We always send an estimate for any enquiry. Payment must be made at the time when you order.

    The estimate must necessarily be accepted and returned to the salesperson to confirm the order, which is only finalised after the corresponding
    payment has been made.

    All payments are to be made out to the firm headquarters, that is to say in Dijon (21000), France.


    Article 4 - Orders

    We accept orders made on our Web site, by telephone or by post; those made by telephone or by post will only be finalised when we have received
    the corresponding payment

    We recommend that you use the names and references shown on our Web site. Should a problem arise because an error has been made in filling out
    the order, we decline all responsibility and the cost of returning the item is to be met by the buyer.


    Article 5 - Delivery

    Ours products and materials are send usually by emballage collissimo 48h ou collissimo 48 h.Delivery times quoted are indicative but as exact
    as possible. Longer delays do not entitle the buyer to demand compensation, deductions or the cancellation of the order.
    Delivery of items is subject to availability.

    Agreed delivery times can be extended in the case of strike actions, fire, flooding, transport difficulties, manufacturing incidents,
    lack of primary material due to problems with our suppliers, or any other cause considered as a case of absolute necessity.

    Delivery is made directly to the client and must be signed for.

    The loss, theft or damage to the items is covered by insurance. If they are lost, the client will be reimbursed once postal or shipping enquiries
    have been completed. Customers should refuse damaged parcels, which we will replace as soon as we have received the returned parcels.


    Article 6 - Guarantee

    We guarantee the quality of all products sold for a year after the date of despatch. The guarantee applies exclusively to manufacturing defects
    or hidden flaws. It cannot exceed the value of repair or replacement of the item by our suppliers. Any other compensation for damages,
    particularly concerning manpower costs, loss of profit or commercial losses is excluded from our guarantee.

    Our guarantee only applies if our items are stocked in proper conditions or used normally in conformity with the instructions provided on
    our Web page and on the manufacturer's manual.


    Article 7 - Complaints - Return of goods complaints

    Any complaint concerning non-conformity of items must be made in writing and sent to the seller within 3 working days after arrival at destination.
    Formal complaints should mention the references indicated on the invoice.

    No returned item will be accepted without prior written agreement by the seller. In this case the goods must be returned in the original packing
    and shipping costs will be paid by the client. If an item is returned to us without our agreement, we reserve the right to send it back postage due.

    If the item does not correspond to what has been ordered, we can only offer replacement of the item or give you a credit corresponding at
    the most to its market value. We reserve the right to choose the most suitable method in this case.


    Article 8 - Responsability

    Cuisine Innovation cannot be held responsible for the non-respect of the contract in case of absolute necessity: fire, flooding,
    the breakdown of machinery, strikes, especially postal strikes, war, unforeseeable interruption of supplies etc...


    Article 9 - Title of retention clause

    The title to the goods shall remain vested in the Seller and shall not pass to the Buyer until the purchase price for the goods has been paid
    in full and received by the Seller. As soon as the Buyer has taken possession of the goods, he/she is responsible for the damage that these
    goods could undergo or incur, the integrality of the risks having been transferred to him/her.


    Article 10 - Place of jurisdiction: Dijon
